Illinois law provides for the filing of traffic infraction charges by the person who observes the violation take place. In order to successfully prosecute such a case, the reporting party must be willing and able to do the following:
* Describe behavior by the offender which constitutes a violation of Illinois law.
* Sufficiently describe the suspect vehicle and its operator to assist law enforcement personnel in identifying the alleged offender.
* Positively identify the offender in a photo line up.
* Sign a formal complaint.
* Testify on behalf of the State of Illinois or Village of Montgomery in any and all court hearings/trials resulting from the filing of such charges.
